FAA Rules for Flying Drones Over People and Moving Vehicles

A Part 107 certificate, aircraft registration, and Remote ID do not automatically authorize flight over people. Routine operations over people and occupants of moving vehicles must fit one of the FAA’s four categories or another specific exception. The aircraft configuration and the way the site is controlled both matter.

Start by Identifying Who Is Under the Flight Path

Part 107 allows flight over a person who is directly participating in the operation. It also allows flight over a person located under a covered structure or inside a stationary vehicle that provides reasonable protection from a falling drone. Other operations over people must meet the requirements of Category 1, 2, 3, or 4, or operate under a waiver.

A customer, roofer, construction worker, bystander, resident, driver, or event attendee is not automatically a direct participant. Direct participation depends on involvement in the operation and awareness of the risk, not simply being present at the job site.

The Four FAA Categories

Category 1

The aircraft must weigh 0.55 pounds or less at takeoff and throughout the Category 1 operation, including everything attached or carried. It may not contain exposed rotating parts that would lacerate human skin on impact.

A sub-250-gram product is not automatically Category 1. Propeller design, guards, payload, lights, and other attachments affect eligibility and weight. For sustained flight over an open-air assembly, the operation must also satisfy the applicable Remote ID requirement.

Category 2

Category 2 uses a performance-based aircraft standard. The aircraft must not cause injury equivalent to or greater than the severity caused by an 11 foot-pound kinetic-energy transfer from a rigid object. It must have no exposed rotating parts that would lacerate skin and no safety defects.

The aircraft must be listed on an FAA-accepted declaration of compliance and labeled as eligible for Category 2 operations. The operator must follow the applicable operating instructions and configuration limitations. A parachute or propeller guard does not create Category 2 eligibility by itself unless the complete declared configuration supports the FAA-accepted compliance path.

Category 3

Category 3 uses a 25 foot-pound injury-severity threshold and the same general requirements for exposed rotating parts, safety defects, declaration of compliance, labeling, and operating instructions. It also imposes stricter operating limits.

  • The aircraft may not operate over open-air assemblies.
  • The operation may occur within or over a closed- or restricted-access site when everyone on site is on notice that a drone may fly over them.
  • Outside that site-control path, the aircraft may not maintain sustained flight over a person unless that person is directly participating or is protected by a covered structure or stationary vehicle.

Category 4

Category 4 applies to a small unmanned aircraft with an FAA airworthiness certificate. The aircraft must be operated within approved limitations that do not prohibit flight over people, and the owner or operator must satisfy the applicable maintenance, inspection, alteration, and recordkeeping requirements.

Category 4 should not be confused with a typical consumer or enterprise drone that is registered and Remote ID compliant. An airworthiness certificate is a separate FAA certification status.

Open-Air Assemblies and Remote ID

Part 107 does not define every crowd by a fixed head count. An open-air assembly is evaluated from the facts of the site, including density, movement, ability to disperse, and exposure. Concerts, festivals, stadium crowds, demonstrations, and dense public events can present obvious open-air assembly conditions.

Category 1, 2, and 4 operations may not maintain sustained flight over an open-air assembly unless the operation complies with the applicable Remote ID requirement. Category 3 operations are prohibited over open-air assemblies.

Operations Over Moving Vehicles

Flight over a person inside a moving vehicle must meet Category 1, 2, 3, or 4 requirements. For Category 1, 2, or 3, the aircraft must either remain within or over a closed- or restricted-access site where occupants are on notice, or avoid sustained flight over moving vehicles.

Crossing a roadway for a brief transition is not the same as tracking above traffic for an extended period, but “brief” is not a blanket exemption. The route, timing, traffic density, aircraft category, and whether the flight is sustained must be evaluated together.

Practical Site-Control Methods

  • Schedule the operation when the site is closed or lightly occupied.
  • Create a controlled launch, recovery, and flight area with barriers or spotters.
  • Notify workers and occupants when a Category 3 restricted-access path is used.
  • Use camera angles and orbits that keep the aircraft beside—not directly above—people and traffic.
  • Pause the mission when an uninvolved person enters the flight path.
  • Use a smaller or category-eligible aircraft when the mission genuinely requires operation over people.
  • Document the exact aircraft configuration, category label, operating instructions, and declaration of compliance.

Common Compliance Errors

  • Assuming everyone on a customer’s property is a direct participant.
  • Assuming a drone qualifies for Category 1 because the base aircraft is marketed as under 250 grams, while the flight configuration is heavier.
  • Adding propeller guards or a parachute and declaring the aircraft Category 2 or 3 without an FAA-accepted compliance path.
  • Ignoring the category label or operating instructions for a specific configuration.
  • Maintaining sustained flight over a public road because the aircraft crosses quickly during each orbit.
  • Treating Remote ID compliance as permission to fly over an open-air assembly.
  • Failing to re-evaluate the operation when workers, customers, pedestrians, or vehicles move into the area.

Frequently Asked Questions

Can I fly over a client standing next to me?

Only if the person is directly participating in the operation, is protected by a covered structure or stationary vehicle, or the operation satisfies an applicable category or waiver. Being the client does not automatically make the person a participant.

Does a propeller cage make a drone Category 1?

It can address exposed rotating parts, but Category 1 also requires the complete aircraft to weigh 0.55 pounds or less throughout the operation. The actual configuration controls.

Can a Category 3 drone fly over a construction site?

It may be possible when the site is closed or restricted access and everyone on site is on notice, or when the operation avoids sustained flight over people except those protected or directly participating. The aircraft must also meet Category 3 eligibility and labeling requirements.
